Outschool Cash, Credit and Card Policy

The following terms and conditions (the “Cash, Credit and Card Policy”) apply to the receipt and use of Outschool cash, credit, and gift cards (including digital gift cards, physical gift cards), and any other gift certificates that may be issued or provided by Outschool, Inc. (“Company”). This Cash, Credit and Card Policy is subject to Company’s Terms and Conditions, available at https://outschool.com/terms and expressly incorporated herein by reference.

By purchasing, activating or otherwise using Outschool cash, credit, and/or gift cards, you expressly acknowledge that you understand and agree to this Cash, Credit and Card Policy and the Outschool Terms of Service, including its arbitration provisions. IF YOU DO NOT AGREE TO THE CASH, CREDIT AND CARD POLICY OR OUTSCHOOL TERMS OF SERVICE (INCLUDING ITS ARBITRATION PROVISIONS), THEN DO NOT PURCHASE, ACTIVATE OR OTHERWISE USE OUTSCHOOL CASH, CREDIT, AND/OR GIFT CARDS.

Company reserves the right to change this Cash, Credit and Card Policy from time to time in its discretion, subject to compliance with all applicable laws.  The most current version of this Cash, Credit and Card Policy will be available on http://outschool.com/pages/cash-credits-card-policy and will supersede all previous versions of this Cash, Credit and Card Policy. Your continued use of Outschool cash, credit, and/or gift cards is your acceptance of all then-current terms and conditions. Void where prohibited, taxed or restricted by law.  All federal, state and local laws and regulations apply.

Outschool Cash and Gift Cards

Outschool cash and gift cards (collectively, “Cards”) can be purchased on https://outschool.com/giftcard/buy or via the Outschool mobile app (collectively, the “Platform”) and redeemed for products and services sold by Company on the Platform. Cards have no expiration date, and you will not be subject to any dormancy fee, transaction fee, or other fees for use or non-use of Outschool cash or gift cards.

A Card is not a credit card and cannot be used as one. Cards are assigned a fixed monetary value.  Use of the Card is limited to the amount of funds held on the Card and it is your responsibility to know the amount of available funds on your Card at all times.  Card balances may not be used to purchase gift cards and cannot be reloaded, resold or transferred for value. Company is not responsible for lost or stolen Cards.

Credit

Credit (“Credit”) may be earned by participating in loyalty, reward, promotional or incentive programs offered by Company. Company may also, in its sole discretion, directly provide credit to a user. Credit may have expiration dates. It is your responsibility to check the terms of any Credit, and be aware of any expiration dates.

Credit will be reflected in your Company account. You are responsible for knowing the value of our Credit. Credit cannot be purchased, and cannot reload, sell, or transfer your Credit for value.

General Conditions

Cards and Credit are not redeemable for cash, and may not be returned for cash or other refunds, either prior to or subsequent to redemption, except to the extent required by applicable law.  Except to the extent required by applicable law, any unused balance will otherwise remain in your Company account and such balances are not transferable. The full amount of each purchase, including taxes, will be deducted from the funds available in Credit and/or held on the Card, up to the total funds available.  If a purchase made with a Credit/Card exceeds the amount of the Credit/Card, you must pay the balance as otherwise required by Company’s standard terms of sale and Terms and Conditions. For combinations with other offers, restrictions may apply.

Cards and Credit are subject to verification, and any Card or Credit that we believe in our sole discretion to have been purchased or obtained fraudulently or through illegal means will be subject to invalidation without refund. The use of Cards and Credit in any manner that states or implies that any person, website, business, product or service is endorsed or sponsored by, or otherwise affiliated with Company is prohibited without prior written approval.

Outschool may also apply Cards or Credit directly to your Company account, without any purchase by you, in connection with a promotion, contest, program, or otherwise at Outschool’s discretion. Outschool reserves the right to withhold, revoke, or deduct Outschool Cards and/or Credit that has been applied to your account by Outschool, if Outschool determines or believes that its application was in error, fraudulent, illegal, or in violation of the applicable promotion or program terms.

Deletion of your Company account will result in the irrevocable loss of any Cards and/or Credit balance remaining at the time of deletion. Please check your account for any balance prior to deleting.

THEFT, DIVERSION, REPRODUCTION, TRANSFER, SALE OR PURCHASE OF ANY CARD OR CREDIT IS PROHIBITED. COMPANY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO CARDS AND CREDIT, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  IN THE EVENT A CARD OR CREDIT IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH CARD, TO THE EXTENT PERMITTED BY APPLICABLE LAW. THE RISK OF LOSS AND TITLE FOR CARDS AND CREDIT PASS TO THE PURCHASER UPON OUR PHYSICAL OR ELECTRONIC TRANSMISSION TO THE RECIPIENT, WHICHEVER IS APPLICABLE.  ANY USE OF CARDS OR CREDIT FOR UNAUTHORIZED PURPOSES IS STRICTLY PROHIBITED.  IN NO EVENT WILL COMPANY BE LIABLE FOR ANY PUNITIVE, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES.
