Parental guidance and supervision is required. This class includes a strenuous workout. There is a risk of injury if the skills are not preformed correctly by the participants.  If your child has any physical limitations, please let me know. 

Please choose a location with plenty of space to move around, and no hard objects nearby. Please monitor your child to make sure they are safe, following instructions and not over exerting themselves. They should have a water bottle nearby.

Release and Waiver of Liability and Indemnity Agreement:
In consideration of my child being allowed to participate in any way in the activities of P.E. With Eden, I acknowledge, appreciate and agree that:

By signing up for this class I am agreeing to this Participant Waiver, I am assuming certain risks and waiving certain rights, including a right to sue. 

 I, THE PARENT OR GUARDIAN, UNDERSTAND THAT THE PARTICIPATION OF ANY ATHLETIC ACTIVITY CAN RESULT IN POSSIBLE INJURY, DEATH OR PROPERTY DAMAGE.  I ACKNOWLEDGE THAT ACTIVITIES TAKING PLACE DURING P.E. WITH EDEN'S CLASSES HAVE INHERENT RISK OF INJURY, INCLUDING, BUT NOT LIMITED TO, THOSE RELATED TO CONTACT WITH THE GROUND, ITEMS SURROUNDING THE GROUND, CONTACT WITH OTHER INDIVIDUALS ON THE GROUND, CONTACT WITH EQUIPMENT ON THE GROUND.  I ACKNOWLEDGE THAT ANY INJURIES SUSTAINED MAY BE COMPOUNDED BY NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS OF P.E. WITH EDEN.  I ACKNOWLEDGE THAT I AM VOLUNTARILY ALLOWING MY CHILD TO PARTICIPATE IN THE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND I FURTHER ASSUME ALL RISKS, INCLUDING INJURY, DEATH AND PROPERTY LOSS AS A RESULT OF MY CHILD'S PARTICIPATION IN THIS CLASS, EVEN THOUGH SUCH RISKS MAY HAVE BEEN CAUSED BY THE NEGLIGENCE OF P.E. WITH EDEN. I AGREE TO WAIVE AND RELEASE AND COMPLETELY HOLD HARMLESS P.E. WITH EDEN, ITS REPRESENTATIVES AND ITS COACHES, ON BEHALF OF MYSELF, MY EXECUTORS AND ASSIGNS, FROM ANY LIABILITY, CLAIMS, CAUSE OF ACTION OR LAWSUITS ARISING OUT OF OR ATTRIBUTABLE TO THE ACTIVITIES, WHETHER ARISING OUT OF THE NEGLIGENCE OF P.E. WITH EDEN, ITS REPRESENTATIVES AND COACHES OR OTHERWISE, TO THE FULLEST EXTENT PERMITTED BY LAW. I COVENANT NOT TO MAKE OR BRING ANY SUCH CLAIM AGAINST P.E. WITH EDEN,  ITS REPRESENTATIVES AND COACHES AND FOREVER RELEASE AND DISCHARGE P.E. WITH EDEN, ITS REPRESENTATIVES AND COACHES FROM LIABILITY UNDER SUCH CLAIMS.

P.E. With Eden strongly recommends that you consult with your physician before your child begins any exercise/fitness program/class. Your child should be in good physical condition and be able to participate in strenuous exercise. P.E. With Eden is not a licensed medical care provider and represents that they have no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific exercise on a medical condition.

This waiver is governed by Colorado law.  If any provision of this document is found inadmissible in court or unlawful it shall not affect the remaining provisions, and those remaining provisions shall continue in full force and effect.  

By signing up for this class, I acknowledge that I read the waiver and I fully understand the terms of the waiver and I am voluntarily giving up the rights set forth in the waiver.
